Terms of service

These terms are the agreement between you and us when you use Mintoo. We've kept them short. Please read them in full.
Template
1. Who we are
Mintoo is operated by [Company name] [GmbH or UG (haftungsbeschränkt)], [Street and number], [Postcode] [City], Germany ("we", "us"). Full details are in the Imprint.
2. What Mintoo is
Mintoo is an app for chatting with people you know and sending or requesting money with them. It is software that lets you use your own wallet. It is not a bank. We don't hold, transfer or exchange money for you: you move your own money. Adding money by bank transfer is provided by a licensed verification and payments partner (coming soon).
Your balance is EURC, a euro stablecoin (an e-money token) issued by Circle Internet Financial Europe SAS, authorised in France. It's held in your own wallet; Mintoo never holds your money. EURC isn't a bank deposit and isn't covered by deposit insurance.
Mintoo can also show USDC, a US dollar stablecoin issued by Circle, if you receive it. The same rules apply. How it all fits together is explained in How Mintoo works.
3. Who can use Mintoo
- You must be at least 18 years old and able to enter into a contract.
- You must live in a country of the European Economic Area. Mintoo isn't available in sanctioned countries, or to people on sanctions lists. See Countries.
- You may have one account, for yourself, for personal use. Business use isn't allowed.
- The information you give us and our partners must be true and up to date.
4. Your wallet is self-custodial
- When you sign up, a wallet is created for you with Privy's wallet technology. Only you can approve payments from it.
- We never hold your private key or your money. We can't move, freeze, reverse or recover funds in your wallet.
- Keep access to your email, your Apple or Google account and your devices secure. You are responsible for payments you approve.
- Payments are recorded on the Solana network. They are final and public (amount and time, not your name).
5. Payments and limits
You approve each payment on your device. Payments from €500 also need Face ID or your fingerprint. These sending limits apply:
| Not verified | Verified (soon) | |
|---|---|---|
| Per payment | €150 | €10,000 |
| Per 30 days | €1,000 | €15,000 |
Higher limits are available after identity verification, once offered. We may change limits for your safety or to meet legal requirements. Receiving money is never limited by Mintoo. We may ask you to verify before sending again if we see unusual activity.
6. Identity checks and adding money
Adding money by bank transfer and identity verification are coming soon. They'll be provided by a licensed verification and payments partner, which we'll name here before they start. Adding money, cashing out and higher limits will need an identity check carried out by that partner under its own terms and privacy policy. We'll receive the result, not your documents.
7. Fees
We don't charge for sending, requesting or receiving money today. Third parties may charge fees, for example for adding money. Any fee is shown before you confirm. See Fees. We'll tell you at least [notice period] in advance before we introduce a fee.
8. Acceptable use
You agree to follow our Acceptable use policy. It prohibits, among other things, sanctions evasion, money laundering, fraud, scams, gambling and illegal goods or services.
9. Risks
Stablecoins and self-custodial wallets carry risks that bank accounts don't, such as final payments and no deposit insurance. Please read Risks before you add money.
10. The beta and test money
Mintoo is in a closed beta. During the beta, balances are test money on a test network. Test money has no value, can't be bought, sold or cashed out, and may be reset. Features may change, and the service may be interrupted. We'll tell you before real money is enabled.
11. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For slight negligence, we are liable only for breach of an essential contractual obligation, limited to the damage typical and foreseeable for this kind of contract. We are not liable for payments you approved, for losses caused by the Solana network, by EURC's issuer or by our partners' services, as far as the law allows. [Have this clause reviewed by your lawyer.]
12. Ending your account
- You can delete your account at any time in Settings. Before you do, move your balance to another wallet; we can't do it for you later.
- We may end the contract with [notice period, e.g. 2 months] notice, or immediately for good cause, for example a breach of the Acceptable use policy or a legal requirement.
- When your account ends, your wallet and its balance stay yours. We keep data only as described in the Privacy policy.
13. Changes to these terms
We'll tell you about changes in the app or by email at least [notice period] before they apply. If you don't agree, you can end your account before then at no cost.
14. Governing law and complaints
[German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, you keep the protection of the mandatory laws of the country where you live. Confirm with your lawyer.] For complaints, see our complaints process.
